Landowner Application and Assessment Terms
Version 2026-10-v3. These terms apply when you submit a property to Beacon Nest Tradings Limited and, separately, if you engage us for a paid feasibility assessment.
In short: applying is free and creates no obligation. If your property passes our initial screening, we may offer a paid feasibility assessment. That assessment is a professional service with a defined purpose. It is not a promise of funding, approvals, returns or a joint venture, which require separate written agreements.
1. Who and what these terms cover
"Beacon Nest", "we" and "us" mean Beacon Nest Tradings Limited, a company incorporated in Kenya. "You" means the person submitting a property, on your own behalf and for any co-owners you represent. These terms cover (a) your application and our initial screening, and (b) the property feasibility and development assessment if you accept it. They sit alongside our website terms and privacy policy.
2. Applying and initial screening
Submitting a property and our initial screening are free. We review the information you give us against our screening criteria, such as title, ownership, charges, size and access. Submission is not approval. We may approve the property for a feasibility assessment, ask for more information, or decline, and we are not obliged to give detailed reasons.
3. Information you provide
You must give accurate and complete information about the property and its ownership, and you confirm you are entitled to provide it. You must tell us promptly if anything changes, including any dispute, charge, caution, succession matter or the unwillingness of a co-owner to take part. We may rely on what you tell us, and may decline or stop work if it proves inaccurate or incomplete.
4. The feasibility assessment: purpose and scope
The purpose of the assessment is to evaluate the property's development potential, identify relevant risks, assess preliminary commercial viability and recommend whether the opportunity should proceed, and in what way. Beacon Nest determines the appropriate assessment methodology, the professional investigations to be carried out and the contents of the report, acting reasonably and in line with the agreed scope of work.
Unless the agreed scope says otherwise, the assessment fee does not include every possible soil test, 3D design, detailed bill of quantities, statutory approval or technical investigation. Additional work is handled under a separately agreed scope and cost.
5. Assessment fee and payment
The proposed fee is KES 100,000 for properties in Nairobi and KES 170,000 for properties outside Nairobi, determined by the location of the property, not your residential address. Where the classification is unclear we confirm it with you before issuing the fee. The fee becomes payable only after your property has been approved for feasibility and we have issued payment instructions in writing.
Before you pay, we show you the fee, the scope and the payment terms again and ask you to accept them. Payment is made by bank transfer or M-Pesa paybill, only to the Beacon Nest account details shown to you on your application page, quoting your application reference or M-Pesa code. We never ask you to pay a personal account or mobile number. A payment is treated as received only when we have verified it against our bank statement. Telling us you have paid, or sending a screenshot, does not by itself confirm payment.
6. Cancellation and refunds
The assessment fee is for a defined professional service. The engagement starts automatically at the moment we verify your payment against our bank statement, and we confirm this to you by email. From that moment the fee is non-refundable, subject to the agreed contract terms and applicable law. There is no cooling-off or cancellation period after payment, which is why we show you the fee, the scope and these terms, and ask you to accept them, before we show you our bank details.
Before paying, please check the amount, the account and your payment reference carefully. If you pay more than the fee, or pay twice, we will refund the excess or duplicate amount, less any bank charges. If we are unable to deliver the agreed service for reasons within our control, we will refund the part of the fee that relates to work not performed. Third-party costs incurred at your request are not refundable. Nothing in these terms limits any right you have under applicable law.
7. What payment does not mean
Payment of the assessment fee does not guarantee funding, construction, planning or other approvals, financial returns, or that a joint venture or other agreement will be concluded. The assessment may conclude that a property should not proceed. That outcome is a valid result of the service you paid for.
8. Assessment versus a binding development agreement
A feasibility assessment, a report, a meeting, a letter or an email from us is not a binding development agreement. A development partnership, whether for apartments for sale or rental apartments, proceeds only if both sides choose to continue after the assessment and due diligence, and only on separate written agreements signed by the parties. Until then nothing is committed on either side and no interest in your land is created. You should take independent legal advice before signing anything.
9. Your information and documents
We use the information and documents you provide to assess your property, communicate with you and administer your application. We handle personal data in line with the Data Protection Act, 2019 and our privacy policy. We limit access to the people who need it, and we do not sell your information. We may share it with professionals engaged to carry out the assessment, who are expected to keep it confidential. Please send title documents only through the channels we give you.
10. Use of our work
The assessment report and our recommendations are prepared for you and for Beacon Nest's evaluation of the opportunity. You may not present them to third parties as an independent valuation or as a statement of Beacon Nest's commitment.
11. Limitation of liability
To the extent permitted by law, Beacon Nest is not liable for indirect or consequential loss, or for loss arising from information you supplied that was inaccurate or incomplete. Nothing in these terms limits liability that cannot lawfully be limited.
12. Changes, governing law and contact
We may update these terms. The version you accepted is recorded against your application with the date and time. These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction over any dispute arising from them.
